Key Changes in Tenancy Laws with Bill 14 – Tenancy Statutes Amendment Act, 2024

Bill 14 – Tenancy Statutes Amendment Act, 2024, which amends both the Residential Tenancy Act and the Manufactured Home Park Tenancy Act, received Royal Assent on May 16, 2024. This new legislation introduces significant changes aimed at providing greater protections for tenants. Here are the key changes that landlords and tenants need to be aware of:

Changes Effective April 3, 2024:

  • Extended Occupancy Requirement: Landlords must now occupy a rental unit for 12 months (previously 6 months) after ending a tenancy for personal occupancy.
    ‍
  • Eviction Restrictions for Larger Buildings: Evictions for personal occupancy are prohibited in purpose-built rental buildings with 5 or more units.

Changes Effective May 16, 2024:

  • Conditions for Ending Tenancy: Landlords are prohibited from issuing a notice to end tenancy unless the specific requirements or circumstances apply, or if the landlord had a reasonable belief that they applied.
    ‍
  • Additional Occupant Charges: Landlords can no longer charge extra rent for additional occupants who are minors.

Upcoming Changes Over the Summer:

  • Extended Notice Period: The notice period for ending a tenancy for personal occupancy will increase from 2 months to 4 months.
    ‍
  • Extended Dispute Period: Tenants will have 30 days (up from 15 days) to dispute a notice to end tenancy for personal occupancy.
    ‍
  • Mandatory Use of Web Portal: Landlords will be required to use a web portal on the Residential Tenancy Branch (RTB) website to generate notices to end tenancy for personal occupancy.

These amendments are designed to balance the needs of landlords with enhanced protections for tenants, ensuring a more stable and fair rental market.
